Washington mixes a strong tribal casino scene with some of America’s toughest online gambling rules.

Washington may share a name with the nation’s capital, but when it comes to gambling, the Evergreen State writes a rulebook entirely of its own.
On one side, Washington has a substantial tribal casino industry, with everything from blackjack and roulette to electronic gaming terminals and legal sportsbooks. On the other, take those same activities online and the legal picture changes dramatically.
The state’s basic philosophy is unusually clear: gambling is illegal unless Washington law specifically authorizes it. The Washington State Gambling Commission currently states that all 29 federally recognized tribes in the state have Class III gaming compacts, while 23 tribes operate 29 casinos under those agreements.
That creates an unusual combination. Washingtonians have plenty of legal places to gamble in person, but there is no regulated statewide online casino or online poker market, conventional statewide mobile sports betting is unavailable, and even several gambling-adjacent products accepted elsewhere remain off limits.

Tribal Casinos Rule the Washington Gambling Map
Washington's casino industry is built around tribal gaming rather than commercial casino licenses.
Under the federal Indian Gaming Regulatory Act of 1988, Class III casino gaming can operate on tribal lands when permitted through agreements between tribes and the state. Washington has now entered gaming compacts with all 29 federally recognized tribes, while 23 currently operate casino properties.
Those casinos can offer a much broader gambling menu than Washington's commercial card rooms. Depending on the individual compact and property, permitted games can include blackjack, craps, roulette, baccarat, Pai Gow Poker, poker, keno, off-track betting, electronic Tribal Lottery terminals and sports wagering.
The electronic machines deserve an important footnote. Washington law generally prohibits conventional slot machines, video poker machines and other electronic gambling devices outside authorized tribal gaming. Tribal properties instead operate electronic gaming through systems specifically approved in their gaming compacts, including the Tribal Lottery System.
So while a Washington tribal resort can look and feel much like a large casino elsewhere in America, the legal structure underneath the gaming floor is distinctly Washingtonian.
What About Washington's Commercial Card Rooms?
Washington does have non-tribal gambling establishments, but calling them traditional commercial casinos can be misleading.
The state currently lists 20 licensed house-banked public card rooms, including properties around Seattle, Renton, Tukwila, Lakewood, Everett and elsewhere. These businesses can offer approved card games, including various forms of blackjack, poker and other table games, but they cannot simply install conventional slot machines.
There is another local wrinkle. Washington cities and counties can prohibit gambling activities within their jurisdiction, including card rooms, meaning availability can change from one municipality to another. House-banked card rooms have existed under the current legal framework since 1997, and several local governments have subsequently restricted or prohibited them.
In short, Washington has commercial gambling, but tribal casinos remain the state's true full-scale casino destinations.
Washington Sports Betting: Legal, but Keep It at the Casino
Washington joined the post-PASPA sports betting era in March 2020, when Governor Jay Inslee signed House Bill 2638. Unlike states that opened sports betting to commercial casinos and statewide betting apps, Washington restricted the new market to Class III tribal gaming facilities operating under amended compacts.
The first legal sportsbook launched at Snoqualmie Casino on September 9, 2021, just in time for the opening of the NFL season.
Mobile betting exists, but not in the way players in states such as New Jersey or Pennsylvania might expect. A tribal sportsbook may offer mobile wagering, but its system must use geofencing to ensure bets are placed only while the customer is physically on the casino premises. Drive away from the property and the legal mobile sportsbook effectively goes with it.
Washington also restricts certain betting markets. Authorized sportsbooks cannot accept bets on Washington college teams, college sporting events taking place within the state or minor-league sports.
And those office March Madness brackets? Washington's Gambling Commission says bracket pools, office sports pools and fantasy sports have never been authorized, although tightly regulated 100-square sports boards are permitted.
Online Gambling in Washington: Where the Rules Get Serious
This is where Washington stands apart.
The state's general rule is that real-money internet gambling is prohibited unless specifically authorized. RCW 9.46.240 makes knowingly transmitting or receiving gambling information over the internet or similar communications systems a Class C felony, subject to exceptions created for legally authorized gambling activities.
That means Washington has no regulated online casino market and no regulated real-money online poker market in 2026. The Washington State Gambling Commission specifically says online wagering on sporting events, internet card and table games involving something of value, and online raffle ticket purchases fall under its prohibition.
The restriction also reaches some newer products.
Daily fantasy sports are not authorized. Online gambling products marketed as sweepstakes do not become legal simply because they use a dual-currency or free-entry model if the actual structure constitutes unauthorized gambling. And in December 2025, the Commission stated that participation in online prediction markets offering event-based contracts is not authorized in Washington, while acknowledging that federal litigation over prediction markets continues.
There are, however, two important exceptions to the broader online picture: on-premises mobile sports betting at authorized tribal casinos and licensed online horse-racing wagering.

Washington Lottery: Legal, but Still a Retail Affair
Washington's Lottery has been around since 1982, with the first ticket sold on November 15 of that year.
Players can legally buy state lottery products, including draw games and Scratch tickets, through authorized retailers. What they cannot currently do is buy regular lottery tickets through a website or have an online lottery courier purchase them on their behalf.
Rules effective in January 2026 explicitly state that internet sales and lottery courier services are not authorized in Washington state.
It is another perfect example of Washington's gambling philosophy: the game itself may be legal, while moving that same transaction onto the internet can completely change the answer.
Horse Racing Is Washington's Big Online Exception
Horse racing occupies a separate legal lane.
Washington permits pari-mutuel wagering, and the Washington Horse Racing Commission oversees live racing, simulcasting and advance deposit wagering, or ADW. Online horse betting was specifically authorized in 2004, and licensed ADW operators can legally accept wagers from Washington customers.
For 2026, Emerald Downs received approval for a 51-day live racing season running from May 2 through September 7. The Horse Racing Commission also lists Sun Downs among Washington's racing tracks.
This means a Washington resident cannot legally open a conventional casino app and play blackjack from home, but can place an online pari-mutuel horse wager through an appropriately licensed ADW platform.

How Old Do You Have to Be to Gamble in Washington?
The general legal gambling age in Washington is 18. The Gambling Commission states that anyone under 18 participating in gambling commits a civil infraction, with potential penalties including a fine, community service and forfeiture of winnings.
Individual tribal casinos may operate under their own compact requirements and property policies, so players should still check the rules of the particular venue before visiting.
The Washington Gambling Picture in 2026
Washington proves that a state can have a thriving land-based casino sector without embracing the nationwide march toward online gambling.
Its 29 tribal casinos, commercial card rooms, lottery, horse racing and tribal sportsbooks give residents a considerable range of legal gambling options. Yet almost all of those options remain attached to a specific location, regulatory framework or tribal compact.
The dividing line is particularly sharp online. There is no legal statewide online casino, poker or sportsbook market, while fantasy sports, online sweepstakes gambling and prediction markets remain unauthorized. Horse-racing ADW and tightly geofenced tribal sportsbook apps are the notable exceptions.
